Welcome to Mail Suite (“Mail Suite”, “we”, “us”, or “our”). These Terms & Conditions govern your access to and use of our website, email delivery platform, SMTP services, cloud services, APIs, software, and related services (collectively, the “Services”).
By accessing, registering for, purchasing, or using our Services, you agree to be bound by these Terms & Conditions. If you do not agree with these terms, please do not use our Services.
1. About Our Services
Mail Suite provides cloud-based email delivery infrastructure and related services that may include dedicated SMTP servers, dedicated IP addresses, email relay, SMTP/API access, email delivery tools, campaign management, reporting, monitoring, and technical support.
Specific features, sending limits, infrastructure specifications, pricing, and service availability may vary depending on the plan or service selected.
2. Account Registration
To use certain Services, you may be required to create an account and provide accurate and complete information.
You are responsible for:
- Providing accurate registration and billing information.
- Maintaining the confidentiality of your account credentials.
- All activity conducted through your account.
- Immediately notifying us of unauthorized access or suspected security issues.
You may not create an account using false information or impersonate another individual or organization.
3. Acceptable Use
Our Services must be used only for lawful and legitimate business communication.
You agree that you will not use Mail Suite to send:
- Unsolicited bulk email or spam.
- Phishing or fraudulent communications.
- Malware, viruses, or malicious content.
- Messages intended to deceive or impersonate another person or organization.
- Content promoting illegal activities.
- Content that violates applicable laws or regulations.
- Email to purchased, scraped, harvested, or unlawfully obtained mailing lists.
- Messages designed to bypass spam filters, security systems, or recipient controls.
You are responsible for ensuring that your email campaigns and recipient lists comply with all applicable laws and regulations.
4. Email Sending Responsibility
Mail Suite provides the infrastructure for email delivery. You remain solely responsible for the content of emails sent through your account and for obtaining appropriate consent from recipients where required.
You should maintain appropriate unsubscribe mechanisms and honor unsubscribe and opt-out requests.
Mail Suite does not guarantee that every email will reach the recipient’s inbox. Email delivery can be affected by recipient mail servers, spam filters, sender reputation, domain reputation, content, recipient engagement, blacklists, and other factors outside our control.
5. Prohibited Activities
We reserve the right to investigate accounts that appear to be involved in spam, abuse, fraud, phishing, malicious activity, or other prohibited behavior.
Where necessary, we may:
- Temporarily suspend sending.
- Restrict account functionality.
- Block specific domains, addresses, or IPs.
- Suspend or terminate an account.
- Remove or isolate abusive infrastructure.
- Cooperate with lawful investigations or authorities.
We may take immediate action where continued activity creates a security, reputation, legal, or operational risk.
6. Dedicated IP & Infrastructure
Where a dedicated IP or dedicated SMTP infrastructure is included, the customer is responsible for maintaining responsible sending practices.
Dedicated IP addresses do not guarantee inbox placement or immunity from blacklisting.
We may provide guidance regarding authentication, IP warming, DNS configuration, bounce management, and deliverability best practices, but final delivery results depend on multiple external factors.
7. Payments & Subscriptions
Services are provided according to the pricing and billing terms displayed at the time of purchase or otherwise agreed with the customer.
Unless otherwise stated:
- Services are billed in advance.
- Recurring subscriptions renew automatically according to the selected billing cycle.
- Customers are responsible for maintaining valid payment information.
- Taxes, duties, bank charges, currency conversion fees, or payment-provider charges may apply where applicable.
Failure to receive payment may result in suspension or termination of Services.
8. Service Availability
We aim to provide reliable and continuous Services; however, uninterrupted availability cannot be guaranteed.
Service interruptions may occur because of:
- Scheduled maintenance.
- Emergency maintenance.
- Network or data-center issues.
- Third-party infrastructure failures.
- Internet or DNS problems.
- Security incidents.
- Events beyond our reasonable control.
Where applicable, specific uptime commitments will be governed by the applicable service agreement or SLA.
9. Intellectual Property
All Mail Suite trademarks, logos, software, website content, interface designs, documentation, graphics, and other intellectual property are owned by or licensed to Mail Suite unless otherwise stated.
You may not copy, reproduce, modify, distribute, reverse engineer, or commercially exploit our intellectual property without written permission.
10. Customer Data
You retain ownership of the lawful content and data submitted or transmitted through your account.
You grant Mail Suite the limited rights necessary to process and transmit such data for the purpose of providing the Services.
Our handling of personal information is described in our Privacy Policy.
11. Suspension & Termination
We may suspend or terminate Services where:
- You violate these Terms.
- Your account is involved in abuse or prohibited activity.
- Payment obligations are not met.
- Your activity creates a significant security or infrastructure risk.
- Required by law or a competent authority.
Upon termination, your access to the Services may be disabled and applicable data may be handled according to our Privacy Policy and applicable retention requirements.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Mail Suite will not be liable for indirect, incidental, consequential, special, or loss-of-profit damages resulting from the use or inability to use our Services.
We do not guarantee that emails will always be delivered, opened, or placed in recipients’ inboxes.
13. Changes to These Terms
We may update these Terms & Conditions from time to time. Updated terms will be published on this page with a revised “Last Updated” date.
Continued use of our Services after changes are published constitutes acceptance of the updated terms.
